Domestic Service Rates (effective 3/31/2020) Billing will be based on rates in effect at the time service is rendered. Rates apply within the continental United States and are quoted in U.S. dollars.
Notes A) For field service, "time" is based on travel time to the job from personnel's regularly assigned office location, on-the-job work hours, and return travel to the office location. Travel time will be billed as straight time and will not exceed 8 hours. Travel time from job to job will be charged prorata. B) Overtime applies to all time that Harrison Industrial Services Inc. employee spent working in excess of 8 hours during a normal work day, any time other than normal day shift and any time on Saturdays, and will be billed at 1-1/2 times the regular rate. Any time on Sundays and holidays recognized by Harrison Industrial Services Inc. will be billed at 2 times the regular rate. C) A "man day" is 8 hours time per man during normal day shift working hours. The minimum invoiced for the field service shall be for one-half man day (or four hours); time spent on the job and traveling in excess of 4 hours, but less than 8 hours, may be invoiced as one man day. D) Standby time is chargeable "on call" time during which the service representative is available but unable to proceed with work functions due to jobsite delays. On-site standby time is chargeable at the applicable rate. Off-site standby time is chargeable at 1/2 the applicable rate. While off-site time on weekdays, beyond 8 hours, or on weekends and holidays is considered non-chargeable personal time, the field representative can be made available on an "on-call" basis if required. This availability, when requested, becomes chargeable at applicable straight time rates. On-site time required as a result becomes chargeable at the applicable overtime rate. E) For field service visits which extend beyond two weeks, the service representative will be allowed to travel home on the second weekend with time and expenses chargeable at the applicable rate. F) When Harrison Industrial Services Inc. finds it necessary to hire service representatives of other companies to place in service major equipment, we shall invoice for this service at cost, plus 15% to cover handling. G) Domestic Service may be obtained by contacting Harrison Industrial Services Inc., Antioch, California. H) Foreign Service is available only upon application and acceptance by Harrison Industrial Services Inc. I) Service time can be reserved, pending 24 hour dispatch, at applicable standard hourly rates, based on an 8-hour day. Expenses A) Travel - Plane, private, or rental automobile charges from the point of regularly assigned location of the service representative, return, plus any required local travel. Private automobile use charged at the rate of .37 cents per mile. Tolls and parking fees are additional. When our service representative goes from job to job rather than returning to his headquarters, travel charges will be distributed prorata. B) Living - Expenses for lodging, meals and incidental costs. C) Receipts for air travel, automobile rental and lodging available upon request. Receipts for meals and incidental costs are not required by Harrison Industrial Services Inc., but can be supplied with prior arrangements. D) All expenses are at cost. Sales Terms and Conditions (effective 01/01/2016) The following Terms and Conditions of Sale shall govern all orders and take precedence when terms and conditions between Harrison Industrial Services Inc. (Harrison Industrial Services Inc.) and the Customer differ in substance and/or are in conflict. 1. Pricing Pricing reflected on Harrison Industrial Services Inc. invoices is based on time and material calculations unless a fixed price was previously established by written quotation. Customer purchase orders are subject to review and acceptance by Harrison Industrial Services Inc. 2. Terms of Payment Merchandise remains the property of Harrison Industrial Services Inc. until the invoice therefore is paid in full. Invoice amount is due in full, 30 calendar days from the invoice date unless otherwise specified on the invoice. All overdue accounts will be subject to a late charge of 1.5% per month from due date until paid. Harrison Industrial Services Inc. does not hereby agree to give further time for payment, but rather intends to impose a charge for late payment. Harrison Industrial Services Inc. hereby reserves the right it may have to file a mechanic's lien against the site at which Harrison Industrial Services Inc. performs services. If account is placed in the hands of an attorney for collection, buyer agrees to pay reasonable attorney's fees and all court costs. 3. Limitation of Liability All items sold by Harrison Industrial Services Inc. are sold as component parts. Harrison Industrial Services Inc. takes no responsibility for the assembly thereof. The purchase price does not include any provision for the defense of a product's liability claim for any assembled equipment. Buyer shall, therefore, defend indemnify and hold harmless Harrison Industrial Services Inc. from any claims of liability arising out of the installation, maintenance, and/or operation of any equipment or system assembled from the component parts by buyer. Harrison Industrial Services Inc. shall not be responsible for the acts and workmanship of the employees, contractors, sub-contractors or agents of the Customer. Harrison Industrial Services Inc. shall not be liable to the Customer for any loss or injury to persons or property caused by the negligence of the Customer, its employees, contractors, suppliers or their employees, agents or sub-contractors. In no event shall Harrison Industrial Services Inc. be liable, whether arising under contract, tort (including strict liability and negligence) or otherwise, for loss of anticipated profits, loss by reason of plant shutdown, non-operation or increased expense of operation, service and erection, cost of purchase of replacement production capacity, or for any special, indirect, incidental or consequential loss or damage of any nature arising at any time of from any cause whatsoever. 4. Worldwide Service Harrison Industrial Services Inc. field service is available from Harrison Industrial Services Inc. on a worldwide basis except for areas covered by a U.S. State Department "Travel Warning". 5) Dispute Resolution In the event any dispute arises out of or relating to these Terms and Conditions of the relationship of the parties, the parties shall attempt to resolve their differences by negotiation. These Terms and Conditions and any other agreement between the parties shall be enforced subject to the laws of the State of California. The Customer expressly consents to jurisdiction in Contra Costa County, California. Should any matter result in litigation, the prevailing party in any proceeding arising out of such controversy or claim shall be entitled to receive such party's costs and fees, including reasonable attorney's fees, incurring in connection with such proceeding. |
